Champ d\u2019application<\/strong><\/p><p>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales s\u2019appliquent \u00e0 tous les services fournis par <strong>Mindelo Cultural Lda.<\/strong> (ci-apr\u00e8s \u00ab le Prestataire \u00bb) aux clients (ci-apr\u00e8s \u00ab les Participants \u00bb), notamment pour les visites guid\u00e9es en ville et les excursions sur les \u00eeles au Cap-Vert.<\/p><p><strong>2. Conclusion du contrat<\/strong><\/p><p>(1) La pr\u00e9sentation des visites sur le site internet, dans les brochures ou autres supports ne constitue pas une offre contractuelle ferme.<br>(2) Un contrat est conclu uniquement apr\u00e8s confirmation \u00e9crite ou \u00e9lectronique de la r\u00e9servation par le Prestataire.<\/p><p><strong>3. \u00c9tendue des prestations<\/strong><\/p><p>(1) Le contenu et l\u2019\u00e9tendue de la prestation r\u00e9serv\u00e9e sont d\u00e9finis par la description de l\u2019offre en vigueur au moment de la r\u00e9servation.<br>(2) Le Prestataire se r\u00e9serve le droit d\u2019apporter des modifications mineures \u00e0 l\u2019itin\u00e9raire ou au programme, \u00e0 condition que le caract\u00e8re g\u00e9n\u00e9ral de la visite ne soit pas significativement modifi\u00e9.<\/p><p><strong>4. Prix et conditions de paiement<\/strong><\/p><p>(1) Les prix applicables sont ceux indiqu\u00e9s au moment de la r\u00e9servation.<br>(2) Sauf accord contraire, le montant total de la visite doit \u00eatre r\u00e9gl\u00e9 avant le d\u00e9but de l\u2019activit\u00e9.<br>(3) Les services suppl\u00e9mentaires tels que les frais d\u2019entr\u00e9e, repas, boissons ou transports ne sont inclus que s\u2019ils sont express\u00e9ment mentionn\u00e9s.<\/p><p><strong>5. Annulation par le Participant<\/strong><\/p><p>(1) <strong>Les visites guid\u00e9es en ville<\/strong> peuvent \u00eatre annul\u00e9es <strong>ans frais jusqu\u2019\u00e0 24 heures avant le d\u00e9but.<\/strong>.<br>(2) <strong>Les excursions sur les \u00eeles<\/strong> peuvent \u00eatre annul\u00e9es <strong>ans frais jusqu\u2019\u00e0 48 heures avant le d\u00e9but.<\/strong>.<br>(3) En cas d\u2019annulation tardive ou de non-pr\u00e9sentation, le prix total de la visite sera factur\u00e9.<br>(4) Les annulations doivent \u00eatre effectu\u00e9es par \u00e9crit ou par voie \u00e9lectronique.<\/p><p><strong>6. Annulation par le Prestataire<\/strong><\/p><p>Le Prestataire peut annuler la prestation si :<\/p><ul class=\"wp-block-list\"><li>le nombre minimum de participants n\u2019est pas atteint,<\/li>\n\n<li>e guide est malade ou un autre motif important survient,<\/li>\n\n<li>un cas de force majeure ou un probl\u00e8me de s\u00e9curit\u00e9 emp\u00eache la r\u00e9alisation de la visite.<\/li><\/ul><p>Dans ce cas, toute somme d\u00e9j\u00e0 vers\u00e9e sera int\u00e9gralement rembours\u00e9e.<\/p><p><strong>7. Responsabilit\u00e9<\/strong><\/p><p>(1) Le Prestataire est responsable uniquement des dommages caus\u00e9s intentionnellement ou par n\u00e9gligence grave.<br>(2) Le Prestataire n\u2019assume aucune responsabilit\u00e9 pour les perturbations ou retards dus aux conditions m\u00e9t\u00e9orologiques.<br>(3) Participation is at the participant\u2019s own risk; each participant is responsible for suitable clothing and adequate physical condition.<\/p><p><strong>8. Comportement des participants<\/strong><\/p><p>(1) Les participants doivent suivre les instructions du guide.<br>(2) Les participants adoptant un comportement perturbateur ou dangereux peuvent \u00eatre exclus de la visite, sans remboursement.<br>(3) Les mineurs ne peuvent participer qu\u2019accompagn\u00e9s d\u2019un adulte responsable.<\/p><p><strong>9. Protection des donn\u00e9es<\/strong><\/p><p>Le Prestataire traite les donn\u00e9es personnelles uniquement pour la gestion des r\u00e9servations et conform\u00e9ment aux r\u00e9glementations applicables en mati\u00e8re de protection des donn\u00e9es. Les donn\u00e9es ne sont transmises \u00e0 des tiers que lorsqu\u2019elles sont n\u00e9cessaires \u00e0 l\u2019ex\u00e9cution du contrat ou exig\u00e9es par la loi.<\/p><p><strong>10. Photos et enregistrements vid\u00e9o<\/strong><\/p><p>(1) Les participants peuvent prendre des photos ou vid\u00e9os tant que cela est fait de mani\u00e8re respectueuse et ne perturbe pas la visite. Des enregistrements professionnels sont interdits.<br>(2) Le Prestataire ne r\u00e9alise ou n\u2019utilise des photos ou vid\u00e9os des participants \u00e0 des fins promotionnelles qu\u2019avec leur consentement explicite.<\/p><p><strong>11. Force majeure<\/strong><\/p><p>En cas de circonstances impr\u00e9visibles (par ex. intemp\u00e9ries, restrictions officielles, risques pour la s\u00e9curit\u00e9), le Prestataire peut modifier ou annuler la visite. Une date alternative ou un remboursement sera alors propos\u00e9.<\/p><p><strong>12. Dispositions finales<\/strong><\/p><p>(1) Le droit applicable est celui de la R\u00e9publique du Cap Vert.<br>(2) Si une disposition des pr\u00e9sentes CG est jug\u00e9e invalide, les autres dispositions n\u2019en sont pas affect\u00e9es.<br>(3) Le lieu de juridiction \u2013 dans la mesure o\u00f9 cela est permis \u2013 est le si\u00e8ge de <strong>Mindelo Cultural Lda.<\/strong>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Mindelo Cultural Lda \u2013 City Tours &amp; Island Excursions 1.
