Mindelo Cultural Lda – Stadtrundgänge & Inselrundfahrten

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen gelten für alle Leistungen von Mindelo Cultural Lda (im Folgenden „Anbieter“) gegenüber Kunden (im Folgenden „Teilnehmende“), insbesondere für Stadtrundgänge und Inselrundfahrten auf den Kapverdischen Inseln. Mindelo Cultural Lda (hereinafter “the Provider”) to customers (hereinafter “Participants”), especially for city tours and island excursions in Cape Verde.

2. Vertragsabschluss

(1) Die Darstellung von Angeboten auf der Website, in Prospekten oder anderen Medien stellt kein verbindliches Angebot dar.
(2) Ein Vertrag kommt mit der schriftlichen oder elektronischen Buchungsbestätigung des Anbieters zustande.

3. Leistungsumfang

(1) Inhalt und Umfang der gebuchten Leistung ergeben sich aus der jeweils gültigen Leistungsbeschreibung.
(2) Der Anbieter behält sich geringfügige Anpassungen der Route oder des Ablaufs vor, sofern diese den Charakter der Tour nicht wesentlich verändern.

4. Preise und Zahlungsbedingungen

(1) Es gelten die zum Zeitpunkt der Buchung angegebenen Preise.
(2) Sofern nicht anders vereinbart, ist der Tourpreis vor Beginn vollständig zu zahlen.
(3) Leistungen wie Eintrittsgelder, Speisen, Getränke oder Transportmittel sind nur enthalten, wenn dies ausdrücklich ausgewiesen ist.

5. Stornierung durch den Teilnehmer

(1) City tours may be cancelled free of charge up to 24 hours before the tour begins.
(2) Island excursions may be cancelled free of charge up to 48 hours before the tour begins.
(3) In case of later cancellations or no-shows, the full tour price will be charged.
(4) Cancellations must be submitted in writing or electronically.

Der Anbieter kann vom Vertrag zurücktreten, wenn:

The Provider may cancel the tour if:

• the minimum number of participants is not reached,
• the tour guide is ill or another important reason exists,
• force majeure or safety risks prevent the tour from taking place.

In such cases, any payments already made will be refunded in full.

7. Liability

(1) The Provider is liable only for damages caused by intent or gross negligence.
(2) The Provider accepts no liability for weather-related disruptions or delays.
(3) Participation is at the participant’s own risk; each participant is responsible for suitable clothing and adequate physical condition.

8. Participant Conduct

(1) Participants must follow the instructions of the tour guide.
(2) Participants who behave in a disruptive or unsafe manner may be excluded from the tour without any refund.
(3) Minors may only participate when accompanied by a responsible adult.

9. Data Protection

The Provider processes personal data solely for the purpose of handling the booking and in accordance with applicable data protection regulations. Data will only be shared with third parties when necessary for contract fulfilment or when legally required.

10. Photo and Video Recordings

(1) Participants may take photos or videos as long as this is done respectfully and does not disturb the tour. Professional recordings are not allowed.
(2) The Provider only takes or uses photos and videos of participants for promotional purposes with their explicit consent.

11. Force Majeure

In the event of unforeseeable circumstances (e.g. severe weather, official restrictions, safety concerns), the Provider may modify or cancel the tour. In such cases, an alternative date or a refund will be offered.

12. Final Provisions

(1) The law of the Republic of Cape Verde shall apply.
(2) Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
(3) The place of jurisdiction – insofar as legally permissible – is the registered office of Mindelo Cultural Lda.
