Mindelo Cultural Lda – City Tours & Island Excursions

1. Scope of Application

These Terms and Conditions apply to all services provided by Mindelo Cultural Lda (hereinafter “the Provider”) to customers (hereinafter “Participants”), especially for city tours and island excursions in Cape Verde.

2. Conclusion of Contract

(1) The presentation of tours on the website, in brochures or other media does not constitute a binding offer.
(2) A contract is only concluded once the Provider issues a written or electronic booking confirmation.

3. Scope of Services

(1) The scope and content of the booked service are based on the tour description valid at the time of booking.
(2) The Provider reserves the right to make minor adjustments to the route or programme, provided that the overall character of the tour is not significantly changed.

4. Prices and Payment Terms

(1) The prices stated at the time of booking apply.
(2) Unless otherwise agreed, the full tour price must be paid before the tour begins.
(3) Additional services such as entrance fees, food, drinks or transportation are only included if explicitly stated.

5. Cancellation by the Participant

(1) City tours may be cancelled free of charge up to 24 hours before the tour begins.
(2) Island excursions may be cancelled free of charge up to 48 hours before the tour begins.
(3) In case of later cancellations or no-shows, the full tour price will be charged.
(4) Cancellations must be submitted in writing or electronically.

6. Cancellation by the Provider

The Provider may cancel the tour if:

• the minimum number of participants is not reached,
• the tour guide is ill or another important reason exists,
• force majeure or safety risks prevent the tour from taking place.

In such cases, any payments already made will be refunded in full.

7. Liability

(1) The Provider is liable only for damages caused by intent or gross negligence.
(2) The Provider accepts no liability for weather-related disruptions or delays.
(3) Participation is at the participant’s own risk; each participant is responsible for suitable clothing and adequate physical condition.

8. Participant Conduct

(1) Participants must follow the instructions of the tour guide.
(2) Participants who behave in a disruptive or unsafe manner may be excluded from the tour without any refund.
(3) Minors may only participate when accompanied by a responsible adult.

9. Data Protection

The Provider processes personal data solely for the purpose of handling the booking and in accordance with applicable data protection regulations. Data will only be shared with third parties when necessary for contract fulfilment or when legally required.

10. Photo and Video Recordings

(1) Participants may take photos or videos as long as this is done respectfully and does not disturb the tour. Professional recordings are not allowed.
(2) The Provider only takes or uses photos and videos of participants for promotional purposes with their explicit consent.

11. Force Majeure

In the event of unforeseeable circumstances (e.g. severe weather, official restrictions, safety concerns), the Provider may modify or cancel the tour. In such cases, an alternative date or a refund will be offered.

12. Final Provisions

(1) The law of the Republic of Cape Verde shall apply.
(2) Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
(3) The place of jurisdiction – insofar as legally permissible – is the registered office of Mindelo Cultural Lda.
